Judge Stewart Rice, in Division 71 of the Metropolitan Court on
Hill Street, told ADL-LA members to remove these pictures from its website by
August 31st, because the photos of Boks and Gordon are 'lone' photographs!
Webster's Dictionary defines 'lone' as "unaccompanied." Therefore, ADL-LA
strongly disagrees with his ruling since Boks, as you can see is NOT alone in
the image - but rather obviously accompanied by Nazi Himmler and Pinocchio!
Linda Gordon is NOT alone - she is accompanied by FAT BASTARD. We believe that
Judge Rice is attempting not only to micromanage a public website, but is
also flouting the decisions of higher courts which - without being internet
specialists - have been unwilling to chill free speech, especially satire and
parody (see Supreme Court decision "Hustler Magazine and Larry. C. Flynt,
Petitioners v. Jerry Falwell." No. 86-1278)
In essence, the Judge is forcing SOLEY the Stop The Killing and
ADL-LA websites to remove these particular pictures because Rice concluded on
Tuesday, that Boks and Gordon are alone! The irony is, these exact
images can appear on any other web site, as long as they are not owned
by ADL-LA! So, if you want to save these pictures to be used by your
group on it's web site, e-mails, etc. this can be done perfectly
legally (as long as they don't appear on www.AnimalDefense.com
or
www.StopTheKilling.net !!)
The City of Los Angeles - through Delgadillo's brown nosing,
stubby-fingered henchman, Spencer Hart (aka "Hartless") - has been attempting
to criminalize free speech and expression along with all the rest of the civil
liberties for which our forefathers and the framers fought and died. This is
because Delgadillo and Hartless's supervisor, Richard E. ("Crafty") Kraft, have
taken it upon themselves to use Animal Defense League and Stop The Killing as
platforms to deflect attention from the lies, crimes, and other acts of
lawbreaking by Delgadillo and wifey. The City Attorney's Office believes that
if it can re-direct attention toward animal rights activists, Paris Hilton - or
anyone else into whom Delgadillo can sink his dirty little teeth - then maybe
the public won't focus on his own criminal behaviour, corruption,
prevarications, and deceit.
In the courtroom for all the Animal Defense League hearings sits
Richard E. ("Crafty") Kraft, who makes sure that every presiding judge knows
that if he/she is desirous of climbing the political ladder he/she had better
give something to the prosecution. Judge Rice should have had the moral
rectitude to stand up to this kind of intimidation and pressure - but,
unfortunately, he is stuck in the lower courts and desperately wants to move on
up! (Metro is the PITS - even below the criminal courts building). He is known
by many in the Public Defender's office for being 'politically motivated' in
his decisions. ADL does not begrudge his wanting to move up and out of Metro -
but doing so by ruling against free speech under pressure from the corrupt City
Attorney's Office reeks not only of cowardice, but also makes a mockery of the
justice system.
Judge Rice not only ruled last Tuesday that ADL-LA had to remove
these pictures from its Stop The Killing website, but even though
non-ADL members (independent activists) paused to use Boks' outside,
communal condo call box for a few seconds during a recent picket on July
2nd, he penalized ADL-LA (the non profit corporation) for violating the
focused picketing ordinance! This not only flies in the face of the Supreme
Court's ruling on focused picketing (see Frisby vs. Shultz), but also
constitutes a slap in the face of Justice O'Connor who stated that activists
have the right to picket in neighbourhoods within one hundred feet of their
targets, as long as they don't stand SOLEY in front of one particular dwelling
for the entire duration of the picket.
Activists spent approximately 86% of their time picketing
throughout the neighbourhood and only about 14% passing within 100 feet of his
condo building. Attorneys for ADL-LA are planning to appeal this decision or
doing a writ. A lower court judge's unlawful ruling cannot stand without being
taken up with the higher courts. The problem is that ADL-LA does not have the
money to spend on this legal fight.
Boks and other LAAS employees have unlimited resources in the
City Attorney's Office, as the city acts as LAAS' private attorneys. Hartless
is being paid by your hard-earned tax dollars to concentrate most of his time
on trying to chill and silence Animal Defense League Los Angeles. Yet, ADL-LA
is a non-profit charity that wants to spend its money on flyers, pickets, and
saving the lives of animals. So, Judge Rice's unlawful ruling may have to be
fought at another time in another place.
BUT - DON'T LET THIS GET ANY OF YOU DOWN BECAUSE. . . .
THE ONLY REASON THE CITY ATTORNEY'S OFFICE IS
CONCENTRATING ITS EFFORTS ON A NON- PROFIT CHARITY FOCUSED ON EXPOSING AND
STOPPING THE NEEDLESS KILLING OF LOST AND HOMELESS ANIMALS, IS THAT WE ARE
BEING EFFECTIVE AND WE ARE WINNING!!!

BOKS KNOWS HIS DAYS OF LIES AND FRAUD ARE OVER, so he is doing
everything in his power to try to silence his critics. He was so desperate to
make activists look bad in front of the judge, that he perjured himself on the
witness stand! ADL-LA will hopefully be able to raise the money to bring
perjury charges against him in the future.
ALSO, consider the shameful fact that Brown Nosing-Stubby
Fingers Hartless and his supervisor Richard "Crafty" Kraft(who throughout the
hearing approached Hartless from the audience to give him orders) attempted to
secure a STAY-AWAY ORDER preventing ADL-LA members from doing pickets within
100 feet of Boks' condo. BUT THIS DID NOT HAPPEN. So, ADL-LA and any other
groups who want to sponsor events in or about the neighbourhood of Ed Boks (or
any other current LADAS employee) can freely do so and march right in front of
their dwellings.
We guess the primary message to the activists out there is that
WE ARE WINNING. The City might have all the money, time, and resources in the
world to focus on going after Animal Defense League LA - BUT activists have the
passion, creativity, and determination with which no amount of money can
compete.
If nothing else, Rice's rulings and the prosecutions
overreaching just make activists more determined to start doing demos hosted by
other groups, so that ADL-LA does not have to sponsor as many. If the City and
presiding judge on this case have made it their goal to increase the
frustration of the activist community at large to fight back against repression
by the state of a non profit group known as ADL-LA, then they are doing one
helluva fantastic job! KUDOS!
As John F. Kennedy stated so eloquently: "When you make peaceful
protest impossible, you make violent revolution inevitable." ADL-LA has done
its best to stick to the guidelines the judge has imposed and has gone out of
its way to ensure that laws are not broken at its demonstrations. In fact, ONLY
ADL-LA pickets in Ed Boks' neighbourhood are required by Judge Rice, to have a
legal observer present! But when the City and the judge are hell-bent on
blaming ADL-LA for the actions of non-members and independent activists, there
is nothing left for us to do but to encourage other groups who are NOT ADL-LA
to get out there and fight even harder against a system smacking of
criminality, fascism, and corruption.
ADL-LA will continue sponsoring some pickets on behalf of the
animals inside LAAS, but we are asking other groups to get involved and hold
their own pickets. We will share any and all our leaflets, signs, and banners
